Temporary incapacity

Acute pain and suffering and other inconvenience sustained by the patient immediately after the injury will be compensated for as temporary incapacity. Compensation for temporary incapacity will be paid based on objectively observable facts that are connected to the patient injury. The subjective views of the injured party are not, as a rule, relevant in the assessment of temporary incapacity.

The amount of compensation is determined by the degree of severity of the illness or injury, the duration of the recovery time, procedures, and the need for hospitalization.

Compensation for temporary incapacity is paid from the time the patient injury first materialised until the time the injured party’s health is stabilised, i.e. until the injury is healed or no change is expected to happen in the status of the injury.
